The government has granted judicial powers to the army in
areas outside the metropolitan regions, according to a notification issued on
Tuesday by the Senior Assistant Secretary of the Public Administration
Ministry, Jeti Pro.
Under the provisions of Section 12(1) of the Criminal
Procedure Code of 1898, commissioned officers of the army have been given
executive magistrate powers for a period of 60 days, starting from the issuance
of the notification.
The notification also specifies that these officers will
exercise their judicial authority under various sections of the Criminal
Procedure Code, including Sections 64, 65, 83, 84, 95(2), 100, 105, 107, 109,
110, 126, 127, 128, 130, 133, and 142, in the case of organized crimes.
The empowered executive magistrates will operate under the
supervision of the respective district magistrates or deputy commissioners.
